Under Section 8(h) of the OMA, a closed session of the Board is permitted, upon rollcall vote of 2/3 of the serving members of the Board, “to consider material exempt from discussion or disclosure by state or federal statute.” The state statute involved here is FOIA, Section 13(1)(g) of which exempts from disclosure “Information or records subject to the attorney-client privilege.” Thus written opinions of legal counsel, which are subject to the attorney-client privilege, may be considered in a closed session. 3. Study Session A. Superintendent Search Update The Board of Education will share the next steps in the search for its next Superintendent of Bloomfield Hills Schools. B. Healing and Response Plan Update C. Diversity Assembly Investigation Committee Update The Board of Education will provide an update on Giarmarco, Mullins & Horton, P.C.'s independent investigation following the March 14, 2023 Diversity Assembly at Bloomfield Hills High School. D. Bond Program Committee Update The Bond Program Committee will provide an update on the ongoing construction projects and long-term capital needs. E. FY23 Budget Revisions & FY24 Budget Update The Board of Education will discuss the budget information received for the current fiscal year ending June 30, 2023, as well as what has been forecasted for the fiscal year beginning July 1, 2023. F. Naming of Eastover and Lone Pine Sites Based on recommended safety, security, and operational needs discussed at the April 13 and May 11, 2023 Study Sessions, the 3100 Lone Pine Rd and 1101 Westview Rd buildings will need to be renamed. The Board of Education will review the results of the community input to prepare for future board action. Pursuant to Board Policy 6010, the Board of Education names buildings and these properties are slated for a decision prior to June 30, 2023. G. June 22, 2023 Regular Meeting Agenda Framework Discussion The Board of Education will review the proposed agenda items with the administration slated for placement on the agenda for the June 22, 2023 Regular Board Meeting. H.
